The Use of Mediation as Alternative Capital Market Dispute Resolution

ABSTRACT

The activities of capital market players in the case of securities transactions usually lead to a dispute involving vendors or service providers, agreements, and contracts related to investment, one of the dispute resolution institutions or differences of opinion in the capital market through the procedures agreed by the parties is BAPMI. The role and responsibility of the arbitrator, mediator, and adjudicator in the settlement of disputes in the capital market, the form of dispute resolution conducted by the arbitrator, mediator, and adjudicator in Alternative Dispute Resolution (ADR) outside the court, as well as the enforcement of the decision given by the arbitrator, mediator, and adjudicator to the disputing party in Alternative Dispute Resolution (ADR) outside the court. The results of discussion and analysis of Alternative Dispute Resolution with mediation approach is the right initial choice in solving capital market disputes.
